What You Should Know About Breath Alcohol Ignition Interlock Device (BAIID)

Article by Peter Buh

Since 2009, Illinois has required certain DUI offenders to install a Breath Alcohol Ignition Interlock Device (BAIID) in their cars in order to obtain a permit to drive. A driver’s license is suspended when they are arrested for a DUI and the refuse to submit to chemical testing or provide a sample of blood alcohol (BAC) being.08 or greater. In order for this person to drive during the suspension, they must apply for a Monitored Device Driving Permit (MDDP) and have the BAIID installed on their vehicle.

A BAIID is small device that is installed in your vehicle that measures the amount of alcohol in your breath. To start your vehicle, the driver must submit a sample into the BAIID and the level of alcohol must be under.025 BAC. As you drive the vehicle with the BAIID, the device will require random breath samples. This ensures that the driver did not have a friend submit a sample and allow the DUI offender to drive away. The BAIID keeps all test results and passes the results to the supervising agency. BAC violations or tampering with the BAIID is strictly forbidden and further sanctions or penalties will be imposed.

In Illinois, DUI offenders may only drive a car that is equipped with the BAIID. If you are found driving a vehicle without a BAIID device, you can be charged with a felony and sentenced to prison. Exemptions do exist for individuals who drive an employer owned vehicle. However, you need to obtain permission from the court and notify your employer.

The cost of the BAIID is expensive. According to Dupage County DUI, depending upon whether the suspension is 12 months or 6 months, the cost can be from as low as 00 to as high as 00. It is important to retain an attorney who is highly experienced in DUI law and practices in the county in which you were charged with a DUI. In DuPage County, there are three courtrooms that DUI cases are exclusive for DUI charges. It is important that you retain an attorney who is familiar with the DUI process in DuPage County.
