What is the difference between DUI & DWI Charges? Can you get probation on a Class 5 Felony in Virginia?

In the state of Virginia, what is the difference between the two charges? Is one worse than the other? Also… can you get probation on a Class 5 felony with a good lawyer?

  1. Both DUI and DWI are terms that refer to operating a motor vehicle while impaired by illegal drugs or alcohol. The biggest difference between the two is only in what the letters stand for. DWI is an acronym for driving while intoxicated or impaired and DUI stands for driving under the influence. Throughout the United States, the laws vary regarding how a DUI or DWI is dealt with.

    DUI = Driving under the Influence

    I'm not sure about the probation part. If it is your first offense, I would guess the Judge will fine you and put you on probation and suspend your license

  3. there basically the same-only way u get probation-is having a butt load offf cash and a team of lawyers
