Question by Jordan H: DWI arrest?
A friend of mine got stopped and was given a Breathalyzer which read 5.2, which obviously was impossible to have. The cop was about to let him go when another cop showed up and tried another test which showed .8, so he was arrested for that along with Open Container, running a red light and underage possesion etc.

First of all is that really fair to do?
Secondly, he was driving his friends car, will that have an effect on anything?

  1. Yes it’s fair. Obviously the first breathalyzer was incorrect. They took a second which showed your friend to be under the influence. The fact that he also had an open container, was drinking under the legal age and running a red light proves to me the cops did the right thing. He could have killed someone when he ran the red light. All in all I’d say he’s getting off pretty lightly considering what might have happened.

  2. It is fair to do. Obviously your friend was dumb enough to allow them to give him a test, much less more than one test. People that are accused of a DWI can always refuse to take a breathlyzer test. As far as what car he was driving, that will not matter. As long as he was legally drunk while he was driving, that will be the reason that he got in trouble.

    Your friend deserved to be executed on the spot. If the law was fair, people who drive while intoxicated would be shot on sight.
