How Long Does DUI California Violation Stay On Your Record?

Reader’s Question:

How long does DUI stays in your record. Is it 10 years? I live in California.

The California Vehicle Code states that DUI will stay on your record for 10 years. There are other non- drunk driving California offenses that will report to courts and law enforcement for ten years. This will count against you for the purpose of determining additional or increased penalties for repeat violators, however this will continue to show on a public driving record for only seven years.

This legislation is intended to discourage drunk driving California violation by adding the time-period that a violation stays on person’s driving record.

According to the California Department of Motor Vehicles even if a DUI was previously removed off on your driving record, it will now show back on your driving record and will stay there until ten years from the conviction/offense date. For instance you received a drunk driving California offense in January 2001 and it was set to be taken off your record after seven years it will instead remain on your driving record until January 2011.
