DUI Second Offense In Virginia

What are the penalties involved if you got charged with second offense DUI in the state of Virginia. I have two drunk driving convictions within ten years.

The Virginia Department of Motor Vehicles states that there will be a suspension applied if you get caught driving under the influence.

Since this is your DUI second offense in Virginia, the Virginia DMV states that a conviction for a DUI second offense comes with penalties of:

  • Mandatory minimum $500 fine,
  • Driver’s license revocation for 3 years
  • Possible jail term up to one year

You also mentioned that it is your DUI second offense within ten years, therefore this may carry additional penalty of imprisonment. It is a minimum jail time of ten days.

If you get convicted of DUI second offense within 5 years time, you may be imprisoned for a minimum of 20 days.
