Reader’s Question:

I got a DUI in my driving record and I would like to know if there is any way that to get it expunged here in Georgia? How long will it stay in my record?

The Georgia Department of Driver Services (DDS) states that a conviction for a driving under the influence stays on your driving record forever. For the purposes of knowing if you are a previous DUI violations under Georgia law goes back for five years. So if you get convicted of more than one driving under the influence in the past five years, then the penalties will be greater.

I am not sure about the DUI expungement laws in the state of Georgia. What I know is that you can expunge certain arrest records in the state of Georgia if you have no other criminal charges and you have not been convicted of the same charges in the last 5 years. I believe expungement is not available for drunk driving cases, first violator or conditional discharge pleas.

To be sure about this, I suggest that you verify with the Georgia courts and GA DDS to check if there is any way to have DUI removed of your driving record.
