Can I go after a drunk driver's insurance for collision repairs?

My 1997 Honda Del Sol was hit by a drunk driver while parked. Can I still go after his insurance for the repairs to my car, or do I have to sue him personally.

It was in Edmonton, Alberta so if anyone knows what the procedure is I'd appreciate some tips. The police have been no help and haven't even provided my his insurance information a week after the accident.

  1. If the other driver has insurance, it will have to cover the accident, but the police aren't required to give you his info; you'll have to ask for it. You should be able to get a copy of the police report by new, and that should at least have his name, address, and DL number. With that, you can get his insurance info from the DMV.
  2. Yes, it does have to cover him.
